Terms of Use and Service

1. Purpose

These terms govern access to and use of the Obligia service, an online tool to assist in building, validating and exporting the Register of Information required by Regulation (EU) 2022/2554 (DORA) and ITS (EU) 2024/2956.

2. Nature of service: assistance tool

Obligia provides data-entry, quality-control and xBRL-CSV package generation tools. Obligia is an assistance tool, not a regulatory advisory service. The user remains solely responsible for the accuracy of the data entered, the assessment of function criticality, and the submission of the register to the competent authority (NCA).

3. Account and access

Use of the service requires creating an account with a valid email address. The user is responsible for the confidentiality of their credentials and for all activity carried out through their account.

4. Subscription and payment

The service is offered as an annual subscription paid upfront, at the tiers described on the Pricing page. The publisher is a VAT-exempt small business (Article 293 B of the French General Tax Code): prices are net, with no VAT applied. Payment is due at subscription and at each renewal. The subscription renews automatically for successive twelve-month periods unless cancelled before the renewal date. As the service is a digital service made available immediately, no pro-rata refund is granted for a period already started once access has been provided.

6. Limitation of liability

Obligia implements checks equivalent to those of the regulators to reduce the risk of rejection, without guaranteeing acceptance of the register by the competent authority. The publisher cannot be held liable for rejection, penalties or losses resulting from inaccurate, incomplete data or incorrect classification provided by the user. To the extent permitted by law, the publisher's liability is capped at the subscription amount paid over the preceding twelve months.

7. Availability

The publisher endeavours to ensure service availability. Planned maintenance is announced at least five working days in advance and scheduled outside 08:00–20:00 CET on working days.

For customers subject to DORA (Regulation (EU) 2022/2554), the ICT provider addendum applies and sets quantified service levels: 99.0% monthly availability excluding planned maintenance, an 8 working-hour recovery objective, and a 24-hour maximum data loss objective. Those commitments prevail over this section.

8. Data

Processing of personal data is described in the Privacy Policy. Business data entered by the user belongs to the user. It can be exported at any time from the account: the register export produces the complete xBRL-CSV package, and Export my data in the account settings returns the account record and its audit trail. Deletion is likewise self-service: Delete account removes the account, and removing the last account of an organisation deletes the organisation together with every register it holds. That deletion is immediate and irreversible.

9. Termination

The user may cancel their subscription at any time from their account; cancellation takes effect at the end of the current paid period, which remains accessible until its term. After termination, business data can be exported for 30 days, after which it is deleted or anonymised. The publisher may suspend or terminate access in the event of a serious breach of these terms.

10. Regulatory updates

The publisher integrates European Banking Authority publications within the following periods, counted from their publication: 15 working days for a validation-rule correction, 30 working days for a minor DPM version, 60 working days for a major version, and 5 working days for a change notified by a competent authority.

Registers already built are not affected. Each register keeps the taxonomy version it was built and validated against, so a new publication never changes the meaning of a filing already made.

11. Support

Support requests are answered within 2 working days. A request blocking the production of a register is answered within 4 working hours on working days.

12. Governing law

These terms are governed by French law. Any dispute falls under the jurisdiction of the courts of Toulouse, France, subject to mandatory rules of public policy and to the protective rules applicable to the customer.

13. Documents forming the agreement

These terms, the Privacy Policy and, for customers subject to DORA or acting as a data controller, the processing and ICT provider addendum, together form the agreement. In case of conflict, the addendum prevails over these terms.
